General Terms and Conditions of Sale (T&Cs)

These general terms and conditions of sale apply to product sales concluded on gaevelie.fr between the seller and any consumer acting for non-professional purposes.
1. Identity of the seller

2. Products
Essential characteristics, volume, instructions for use, the list of available ingredients, and any precautions are presented on each product sheet and/or on the labeling. The customer must read them before ordering. The products are cosmetic products and are not intended to diagnose, treat, or cure any disease.
Offers are valid while supplies last. In case of unavailability after an order is placed, the customer will be informed as soon as possible and shall benefit from rights provided by law, in particular a refund when the order cannot be fulfilled.
3. Price
The applicable prices are those displayed at the time of the order, in euros. They include legally applicable taxes when due. Shipping costs and, where applicable, other costs announced to the customer are indicated before final validation of the order.
4. Ordering
The customer selects the products, verifies their basket, enters the information necessary for delivery and payment, then confirms the order. Before payment, they can correct their information and their basket. The order becomes binding after validation of payment, subject to security checks, product availability, and GAÉVÉLIE's right to refuse an order for a legitimate reason, particularly in the event of suspected fraud or a previous payment dispute.
A confirmation email summarizing the order is sent to the customer at the provided address.
5. Payment
Payment is made at the time of the order using the methods offered during checkout. Payments are processed by secure payment providers; GAÉVÉLIE does not have access to the full credit card number when it is processed directly by the provider.
6. Preparation, shipping, and delivery
Orders may be prepared and shipped directly by a manufacturing and logistics partner mandated by GAÉVÉLIE. GAÉVÉLIE remains the seller and the customer's point of contact.
As an indication, a standard order of 1 to 20 items is generally prepared in about 2 business days. For mainland France, standard shipping is then generally expected within a period of up to approximately 6 business days after shipping. Larger orders, periods of high activity, and carrier incidents may require more time. The delivery time or date indicated to the customer before the order is concluded prevails when a specific timeframe is announced.
The destinations actually available are those offered during checkout. Shipping costs are displayed before final validation.
The risk of loss or damage is transferred to the consumer when they take physical possession of the goods, unless otherwise provided by law.
7. Right of withdrawal
For distance purchases, the consumer generally has 14 days from receipt of the goods to notify their decision to withdraw, without having to justify their decision. In the event of separate delivery of several goods in the same order, the period generally runs from the receipt of the last good.
Withdrawal can be exercised by sending a clear statement to rgbusinesscontact07@gmail.com or by using the form found in Article 14 below. After notification, the customer returns the products without undue delay and at the latest within 14 days. Direct return costs are at the customer's expense, unless otherwise provided by law or GAÉVÉLIE.
The consumer may handle the product only to the extent necessary to establish the nature, characteristics, and proper functioning of the product. Depreciation resulting from excessive handling may be taken into account in accordance with the law.
8. Exception for certain unsealed products
The right of withdrawal cannot, in particular, be exercised for goods that have been unsealed by the consumer after delivery and which cannot be returned for reasons of hygiene or health protection. This exception is not applied generally to all opened cosmetic products: it only concerns products that effectively meet the legal conditions of this exception.
9. Returns and refunds after withdrawal
Before shipping a return, the customer is invited to contact GAÉVÉLIE to receive logistics instructions. Unless otherwise stated in writing, the return is addressed to the seller: RGB / GAÉVÉLIE, 8 Lotissement du Lavoir, 38790 Diémoz, France.
In the event of a valid withdrawal, GAÉVÉLIE refunds the amounts due, including initial delivery costs up to the standard delivery method offered, at the latest within the legal timeframe. The refund may be deferred until the goods are recovered or until proof of shipment is provided, whichever is earlier. Unless otherwise agreed, the refund is made using the same payment method as used for the order.
10. Damaged, incorrect, or non-conforming product
If you receive a damaged, incorrect, or defective product, please contact GAÉVÉLIE promptly with the order number and, if possible, photographs useful for processing the file. This request for proof does not limit the consumer's legal guarantees.
11. Legal guarantees

The consumer has two years from delivery of the goods to invoke the legal guarantee of conformity when a lack of conformity appears. Compliance takes the form of repair or replacement, without cost or major inconvenience, under the conditions and timeframes provided by law.
A repair carried out under this guarantee extends the initial guarantee by six months. If the consumer requests repair but the seller imposes replacement under legal conditions, a new two-year guarantee runs from the replacement.
In situations provided for by the Consumer Code, particularly when compliance is refused, impossible, late, or causes a major inconvenience, the consumer can obtain a price reduction or terminate the contract upon return of the goods. Rights relating to conformity result in particular from articles L.217-1 to L.217-32 of the Consumer Code.
The consumer also benefits from the guarantee for hidden defects under articles 1641 to 1649 of the Civil Code, for two years from discovery of the defect, under legal conditions. It may give the right to a price reduction if the good is kept, or a refund upon return.
Any commercial warranties never replace legal guarantees.

13. Consumer mediation
In accordance with the Consumer Code, the consumer has the right, after a prior written complaint that has remained unresolved, to use a competent consumer mediator free of charge. GAÉVÉLIE is currently finalizing the appointment of its referenced mediator; the mediator's name, postal address, and website will be added to this section once membership is confirmed.

16. Applicable law and disputes
These T&Cs are governed by French law. This provision does not deprive a consumer residing in another country of the mandatory protections they enjoy under the rules applicable to them. In the event of a dispute, the legal rules of consumer jurisdiction apply.
